Ultimately, I feel GM needs to make this right, they certainly can afford to fix this type of problem when they are selling such a bogus car. 2 months ago, I would have told every single person I know to buy a chevy. It doesn't take much for one's reputation to be diminished so I am going to keep playing hard-ball and hope they act like customer satisfaction matters.
Thats why the Sales and Service departmenets are different. Go in, talk to your sales guy or speak to the owner of the dealer. I had close ties with one dealer that closed years afterwards and found that most of them integrated into another dealership(where I got my Bu). Owner was very pleasant and is one of the only female owned dealerships that time and time again has one the best dealer award(she was on the cover of time). Had a few discussions with her after purchasing(chit chat) but they have the power to help you out.

Find out who the owner is, call or go into the dealer and request to speak to them, explain the situation and how something like this(problem with so few miles/time and issues with Service) is making you uneasy. See what they can do for you.

I just wanted to provide my experience so far, i posted this on another forum where people were talking about tranny issues with their Malibus:

We have a 2011 Malibu with the similar shifting problems, its been in the shop (dealer) twice now, and the first time they said the shift points were all messed up in the computer (some low pressure, some high). After they reset the computer, the problem went away for about a week, then returned.

We returned it to the dealership again and they provided a 2012 Malibu as a loaner, same tranny and motor however it did not have shifting issues like ours.

The service adviser said no problems could be detected in the computer, so he took it home overnight to see if he could duplicate the problem the next morning, and he did in fact feel the problems with shifting.

UPDATE:

We picked up the car 2 days ago, and the problem appears to be gone, since we havent had any issues so far (however its only been 2 days.)

According to the service papers, the dealership replaced/performed the following:

1x Valve
1x Valve Body Kit (I assume Seals and Gaskets)
8.8 Qts Fluid.
Emergency Rush Delivery of the Parts from GM
Cleaned Valve Body

(They also washed and vacuumed the car, of course)

What they DID NOT REPLACE:
The 1/2 tank of Gas that was in the tank

Our problem was having a serious 2-3 second delay on the 1-2 upshift when warm or cold, and general poor performance when cold. After a cold start the car would feel as if I was towing a heavy load behind it until fully warmed up. After warm up the car would sometimes appear to lock itself into second (or third) gear after stopping at an intersection, rolling back on even the slightest inclines. We have not had any issues since we picked it up 2 days ago and problem appears to be gone. I did contact the GM 1-800 customer service number before taking it in this second time to make sure they were aware of an issue. It appears there are literally thousands of others having similar issues with this transmission.

Well, to add to the tales of woe and intrigue, I was actually bitten by the transmission bug. No problems apparent to me, but my service center where I get my oil changed called me in, took me in the pit, and showed me that I had a transmission leak. After the Christmas rush (I work for Toys R Us), I took it to the dealer. They gave me a nifty Cruze loaner and went to work on it. They found (as I suspected) a leaking front seal. They fixed it, and I was on my way. No drama. By the way, I don't particularly like the six-speed auto; if I had my choice, a 4-speed would have been fine.

I had the 1-2-3-4 clutches in my '11 4-cyl. 6-speed replaced, as well as seals and a module...the car wouldn't go forward at 8,200 miles, leaving my wife stranded alongside a busy two-lane road in the dark at 5:50 in the morning. Ever since the repair, when cold, I think the 2-3 shift is waaayy sloppy--like a two or three second dead spot, although the RPM's don't go up. No codes thrown (of course). Anybody else have any experience, and dealer fix, for this? Thanks. The rebuild was done in December 2011. Don't know if there's a reflash out and available, after that.

My husband recently found a transmission leak on my 2012 malibu. We took it to the dealership only to have them tell us they could not "duplicate" the problem. He had to actually go show them where it was! COME ON! They put dye in it and told us "all cars have residual leaks". REALLY? So we are going to look at it again in a month and take it back in again because we want it documented.
I am really sad to say I am not happy at all with this car. I have had it in the shop several times and bought it with 2 miles on it. I have never had a brand new car with a stack of service tickets.
I am having some serious buyers remorse.

They talked about putting dye in ours, but when they put it on the lift, they decided to just go ahead and fix it.

File an AG's compaint with the dealer!

My Uncle used to own a TON of dealerships in the Portland area, and they hate AG's complaints.

Weston KIA/GMC has been nothing but great with us and our Malibu, more than happy to look at it and fix it. We are still having 2-3 upshift delays and issues but they have been superb in working with us about it.

If you feel they're jerking you around, just file.

I bought an M3 from a dealer that had some frame issues that were not disclosed upon purchase in 05 (care was reconstructed, vin modified, ect. Not reported to insurance/carfax) and I told the dealer I would put a full page ad in the Oregonian Newspaper about it if they didnt buy it back (I paid cash), they bought the car back 2 days later...

You have options...
